Clause n° 1: Company and publisher responsible for the site

The General Terms and Conditions of Sale, described below, detail the rights and obligations of  La Rosa Bianca srl (hereinafter "La Rosa Bianca"), company number  0797.891.019, VAT number BE0797891019, registered office at Rue René Ménada, 52, 1320 Hamme-Mille (Belgium). The sole administrator and editor responsible for the www.larosabiancabride.be website is Mrs. Maria Teresa Silletti, who can be reached at the address info@larosabiancabride.be.

 

Clause 2: Purpose

The goods sold by La Rosa Bianca are: made-to-measure wedding dresses, only for sale in person,  and bridal accessories such as but not limited to, earrings, shoes and veils (hereinafter indicated as "accessories") in person or online - only via the website www.larosabiancabride.be.

 

Clause n° 3: Application of the General Terms and Conditions of Sale

These general terms and conditions of sale apply to the sale of wedding dresses on Belgian territory and to online sales on European territory. The buyer acknowledges having read and accepted them when placing the order.

 

Clause 4: Order

Wedding Dresses

La Rosa Bianca offers a selection of custom made wedding dresses. This means that during the fittings, the bride-to-be (the buyer) tries on a sample dress, we take the measurements and the dress is made for her.

Once the order has been placed, the buyer pays a 30% down payment. La Rosa Bianca places the order to the workshops in Italy only after receipt of the downpayment. The bride acknowledges and accepts the measures indicated in the order form.

Along the way, we will do one or even two fittings, depending on the designer`s decision. Shipping costs and any alterations are the responsibility of La Rosa Bianca. Any changes requested upon final delivery of the dress will be at the charge of the bride (the buyer).

Delivery shall be made in accordance with the terms and conditions specified in clause 10. Delivery.

There is no right of waiver with respect to the sale of custom made wedding dresses.

Accessories

Accessories can be purchased online via the www.larosabiancabride.be website. The purchase is made by following all the steps set up on the site.

The buyer selects the item at the listed price. When placing the order, he/she chooses the country of delivery and the shipping fees are displayed. Once payment has been made, we will send an email confirming the order details. This is not an order confirmation. The acceptance of the order and the execution of the contract between La Rosa Bianca and the buyer will take place when we send a shipping confirmation by email. If the buyer does not receive a confirmation email, it might be in its spam or the address provided when placing the order might be incorrect. We invite the buyer to send an email to info@larosabiancabride.be as soon as possible so that we can take the necessary actions.

If an ordered product is out of stock, La Rosa Bianca will contact the buyer immediately to offer a solution. If no solution is suitable for the buyer, the order will be refunded.

Clause 5: Price

The prices of the goods sold are those in force on the day the order is placed. They are indicated in euros and per unit, and are calculated inclusive of all taxes.

If applicable, shipping costs are indicated when placing the order online.

La Rosa Bianca reserves the right to modify its prices at any time. However, it is obliged to invoice the goods ordered at the prices indicated when the order was placed.

 

Clause 6: Means of payment

Payment for orders is made in cash, by credit card, by QR code, or bank transfer to the IBAN BE bank account....

 

Clause 7: Terms of Payment

 

Wedding Dresses

When placing the order for a custom made wedding dress, the buyer will be required to pay a down payment of 30% of the order, with the balance to be paid upon delivery of the dress. Once the down payment has been paid, under no circumstances, nor for a postponement nor for a cancellation of the wedding, will the down payment be refunded. The wedding dress will have to be paid in full upon delivery. However, in the unfortunate event of a wedding cancellation, although the buyer's obligation to pay the balance of the order remains, La Rosa Bianca is willing, on a case-by-case basis, in a spirit of benevolence but at its own discretion and without guarantee of success, to find the most economical solution in favor of the buyer.

 

Accessories

Accessories must be paid at order placement and before delivery. If the sale is made online through the above mentioned website, payment is made at the time of purchase. Shipping costs are indicated and will be added to the total cost of the order.

Online payment is done in a secure environment by the Stripe platform. If the payment methods are not suitable, the buyer can contact La Rosa Bianca at info@larosabiancabride.be to  discuss about a different mean of payment.

In the event the payment is refused by the bank or credit card, La Rosa Bianca reserves its right to hold or cancel the order and therefore its delivery.

 

Clause 8: Late payment

Wedding dresses are ordered at the workshop in Italy only after receiving the 30% down payment. In case of missed payment, the dress will not be ordered.

Likewise, the balance of 70% must be paid on the delivery date agreed on the order form.

 

Clause No. 9: Ownership

La Rosa Bianca retains legal ownership of the goods ordered until full payment of the order. Hence, if the buyer is withdrawing from the contract and cancels the order, La Rosa Bianca has the  right to claim, according to the regulations in force, the unpaid amounts.

 

Clause No. 10: Termination

If, within fifteen days of the implementation of the "Late payment" clause, the buyer has not paid the outstanding amounts, the sale will be cancelled by operation of law and may give rise to claims in favour of La Rosa Bianca.

 

Clause 11: Delivery

Delivery is made:

  • Either by handing over the goods directly to the buyer;

  • Either by requesting the shipment via the website www.larosabiancabride.be

 

Wedding Dresses

The delivery time indicated when the order is placed is estimated. However, La Rosa Bianca engages to deliver the dress at least 2 weeks before the wedding date or on the date agreed between La Rosa Bianca and the buyer, and indicated in the order form. The delivery of the wedding dress is done in person, ex La Rosa Bianca, Chaussée de Vleurgat 169, 1050 Brussels, location of the showroom. It will not be shipped unless requested in writing by the signatory of the purchase order, declaring that he or she is willing to undertake the risk of damage and loss.

 

Accessories
Our orders are shipped by Bpost (home delivery). The estimated delivery time is indicated when the order is placed. If the wished country of delivery is not listed, the buyer is invited to send an email at the following address info@larosabiancabride.be
so that La Rosa Bianca can inform him/her of the shipping fees to the wished country.

In the event of goods missing or deteriorated during transport, the buyer must notify immediately the transporter upon receipt. The complaint must be confirmed in writing to Bpost within two days of delivery, by registered mail and a copy by email to info@larosabiancabride.be.

We start processing orders as soon as we receive them and shipments are made from Monday to Saturday. Orders are usually shipped within 48 hours of receipt of payment.

Clause 12: Returns and Withdrawals

This close only applies to online sales in accordance with the Belgian e-commerce law.

The buyer has 14 calendar days to exercise his/her right of withdrawal, without having to pay penalties with the exception of return costs, starting the day after the order is delivered. Items must be returned, sealed in their original packaging, quoting the order number to the following address:

La Rosa Bianca will inspect the returned goods as soon as possible and, if not damaged, refund the buyer for the price of the item. Shipping costs are not refunded.

 

Clause No. 13: Force Majeure

La Rosa Bianca cannot be held liable if the non-performance or delay in the performance of any of its obligations described in these General Terms and Conditions of Sale is due to a case of force majeure. As such, force majeure means any external, unforeseeable and irresistible event within the meaning of Article 5.226 of the Belgian Civil Code.

 

Clause 14: Treatement of personal data

La Rosa Bianca treats consumer information in accordance with the current regulations on the Personal Data Policy.

 

Clause No. 15: Jurisdiction

Any dispute relating to the interpretation and execution of these general terms and conditions of sale is subject to Belgian law.

In the absence of an amicable resolution, the dispute will be brought before the Walloon Brabant Company Court.
